Telephone: 07947 131877
References to “Carl Mitchell DJ”, “Carl”, “we”, “us” or “our” mean that trading business. These website terms are separate from the DJ Booking Agreement, which applies when DJ services are booked.
2. Acceptable Use
You may browse the website, listen through the players provided and contact Carl for lawful personal or business purposes. You must not:
- Use the website unlawfully, fraudulently or to infringe another person’s rights.
- Attempt to gain unauthorised access to the website, hosting, forms, accounts or data.
- Introduce malicious code, interfere with security or place an unreasonable load on the service.
- Use automated extraction or scraping in a way that damages the website or republishes protected content without permission.
- Misrepresent an association with Carl Mitchell DJ or use the website to send abusive, misleading or unsolicited material.
Access may be limited where reasonably necessary to protect the website, users or business systems.
3. Original Website Content
Unless stated otherwise, the original copy, photographs, graphics, branding, page designs, videos and other material created for this website belong to Carl Mitchell DJ or are used with permission. You may view them for your own information and share links to public pages.
You may not copy, sell, republish, alter or commercially exploit substantial website content without written permission. Normal quotation, review, reporting and other uses permitted by law are unaffected.
Information is provided in good faith and may be corrected or updated. Package availability, prices and event arrangements are only binding when confirmed in a written booking summary or agreement.
4. Third-Party Music and Mix Rights
House Sessions and other mixes may incorporate recordings, compositions and performances owned or controlled by third-party artists, writers, labels, publishers or other rights holders. Carl Mitchell DJ does not claim ownership of those underlying third-party music rights.
Making a mix available on this website does not transfer any right to copy, download, extract, resell, redistribute, broadcast, publicly perform or commercially use the music. The website player is provided for listening through the functionality offered on the page.
Names, track information and artwork credits are provided for identification and editorial purposes. Rights holders can request a correction or raise a rights concern using the process below.
5. External Websites and Services
The website may link to WhatsApp, Meta services, music platforms, maps, review services, venues, suppliers or other third parties. Those organisations operate their own services and terms. A link does not mean Carl controls or guarantees the external service.
Check the destination and its terms before providing information, joining a community, making a payment or relying on external content. External links may change or become unavailable without notice.
6. Enquiries, Availability and Bookings
Submitting an enquiry, using a calculator or receiving an indicative recommendation does not reserve a date or create a DJ booking. A booking is formed only in the way described in the DJ Booking Agreement and the booking summary issued for the event.
Website prices described as “from”, ranges or estimates depend on the event, venue, timings, travel, package and additional requirements. The agreed total price will be confirmed before a booking is accepted.
7. Responsibility and Liability
Reasonable care is taken to keep the website secure, available and accurate, but uninterrupted access cannot be guaranteed. The website may occasionally be unavailable for maintenance, security, hosting or technical reasons.
Carl Mitchell DJ is responsible for losses that are a foreseeable result of a failure to use reasonable care or a breach of an applicable legal duty. Carl is not responsible for loss that was not reasonably foreseeable, was caused by information or instructions supplied by the user, or arose from an independent third-party service outside Carl’s reasonable control.
Nothing in these terms excludes or limits responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot legally be excluded or limited.
8. Consumer Rights
If you use this website as a consumer, your statutory rights are not affected. Services booked from Carl Mitchell DJ must be performed with reasonable care and skill and contractual terms must be fair and transparent.
Nothing on this website requires a consumer to give up a remedy provided by applicable consumer law.
9. Corrections, Copyright and Rights Concerns
To report inaccurate website information, an accessibility issue, suspected infringement or misuse of your material, email carl@carlmitchelldj.com with the page address, the material concerned and a clear explanation.
For Home Before Midnight track credits or music-rights concerns, email homebeforemidnight@carlmitchelldj.com. Please include enough information to identify the mix, track and basis of the request. Genuine notices will be reviewed promptly and reasonable corrective action will be taken where appropriate.
10. Privacy and Cookies
How personal information, forms, analytics, cookies, WhatsApp links and player interactions are handled is explained in the Privacy and Cookies notice.
11. Changes to These Terms
These terms may be updated to reflect changes to the website, services, providers or law. The version published when you use the website applies to that use. A change to these website terms does not retrospectively alter an already confirmed DJ booking.
12. Applicable Law and Contact
These terms are governed by the law of England and Wales, subject to any mandatory protections that apply where a consumer lives. The courts of England and Wales have non-exclusive jurisdiction; consumers may use the courts available to them where applicable law permits.
